SOCIAL SECURITY BENEFIT PROBLEMS

If you think your social security benefits have been incorrectly calculated:

Ask the Customer Service Manager at your local social security office to explain their decision.

Ask for your claim to be considered by an Adjudication Officer, but this must be within one month of your receiving the decision.

You can appeal to an Independent Tribunal within one month of the date of notification of the decision. (The letter telling you about the decision will tell you if you can appeal.)

If you disagree with the Tribunal's decision you can ask for:

A correction - if you think that the decision includes a simple mistake (such as a mistaken date or amount).

The decision to be set aside - if you think that the Tribunal reached the wrong decision because they did not have an important piece of evidence, or because you or your representative was not at the hearing.

You can appeal on point of law only to a Social Security Commissioner. You may be able to seek judicial review. Contact CAB Cornwall for further advice.
